About your MOU
What is the difference between an MOU and a contract?
A contract sets out binding promises. An MOU records what the parties intend to do, and is often signed before the contract. In the UAE the label does not decide it: a court looks at what the document says. With clear parties, obligations and signatures, an MOU can bind like a contract.
Is an MOU legally binding in the UAE?
It depends on the wording. Clauses written as firm promises can be enforced; clauses written as intentions usually cannot. A good MOU says which is which. Sidqo asks you and writes that split into the draft.
Does an MOU need to be in Arabic?
Not between private parties. English is fine for an MOU you both sign. If it is ever filed with an onshore UAE court or a government body, you will need a certified Arabic translation.
Do we need to notarise an MOU?
No. An MOU is valid once both sides sign it. Notarisation can help prove the signatures later, which is worth considering for property or high-value deals.
